Investor-State Dispute Settlement (ISDS) arbitration between foreign investor and host state

Energy and East-West disputes have one historic home: SCC arbitration in Stockholm. Transnational Matters PLLC represents businesses and investors before the SCC Arbitration Institute as part of our international arbitration practice. Moreover, we advise on SCC clauses in energy, technology, and cross-border supply agreements.

What Is SCC Arbitration?

The SCC Arbitration Institute, part of the Stockholm Chamber of Commerce, has resolved international disputes since 1917. During the Cold War it became the neutral venue for East-West trade, and today it remains a leading forum for energy and investment cases. Notably, many Energy Charter Treaty claims proceed under SCC rules.

Our SCC Arbitration Services

First, we draft SCC clauses and expedited-rules clauses suited to deal size. Second, we represent claimants and respondents through emergency, expedited, and full proceedings. Third, we pursue enforcement worldwide — and we bring treaty experience from our investor-state dispute settlement practice.

SCC Rules, Costs, and Expedited Procedure

SCC costs follow a claim-based schedule that is generally leaner than larger institutions. Furthermore, the Rules for Expedited Arbitrations deliver a sole-arbitrator award on a compressed calendar. As a result, the SCC punches far above its weight for mid-size international disputes.

Why Choose Transnational Matters

In SCC arbitration, we pair civil-law fluency with U.S. advocacy — a strong match for Stockholm’s international caseload. In addition, we work in multiple languages from Miami. Finally, founding attorney Davy Aaron Karkason, Esq. ACIArb maps enforcement targets before filing, so awards convert into recovery.

Key Considerations for SCC Arbitration with Transnational Matters PLLC

What kinds of cases suit the SCC?

Energy, technology, and East-West trade disputes above all. However, SCC arbitration fits general commercial matters equally well.

How fast is the SCC expedited procedure?

Under the SCC Expedited Rules, the award is due within three months of referral, extendable by the SCC Board. (Under the standard SCC Arbitration Rules, the target is six months from referral.) That speed makes the expedited track a fit for smaller claims that cannot absorb multi-year costs.

Does the SCC handle investor-state cases?

Yes. Indeed, the SCC has administered many treaty-based claims, including disputes under the Energy Charter Treaty.

Working with the SCC in practice: renamed the SCC Arbitration Institute in 2023, the institution remains a leading neutral venue for disputes involving European and East–West parties. Under the SCC Expedited Rules, the tribunal is expected to render its award within three months of referral, extendable by the Board — genuinely fast by institutional standards, and a deliberate drafting choice for smaller cross-border contracts.
